1. Introduction

Roo & You Inc. ("Roo & You", "we", "us" or "our") respects your privacy and is committed to protecting it through our compliance with this Privacy Policy. This policy describes how we collect, use, disclose and protect the personal information of our customers and the users of our website, rooandyou.ca (the "Website"). "Personal information" means any information about an identifiable individual. It does not include business contact information that is used to communicate with an individual in relation to their employment, business or profession.

This policy applies to information we collect on the Website; in email, text and other electronic messages between you and the Website; and through any mobile or desktop applications you use to interact with the Website. It does not apply to information collected by any third party, including through any website, application or content that may link to or be accessible from the Website. Those third parties have their own privacy policies, which we do not control.

Please read this policy carefully. By accessing or using the Website, you indicate that you understand and accept the practices described in it. This policy may change from time to time (see Section 14). Your continued use of the Website after we make changes means you accept those changes, so please check the policy periodically for updates.

2. Information We Collect About You

We collect and use several types of information from and about you, including:

  • personal information, such as your name, mailing address, email address, telephone number, internet protocol (IP) address, username or similar identifier, and billing and account information;
  • demographic information and statistical or aggregated information that does not identify you on its own;
  • technical information, including your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, internet connection, and the equipment you use to access the Website;
  • usage details, including the full URLs, clickstream to, through and from the Website, products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks and mouse-overs), and methods used to browse away from the page;
  • any phone number used to call our customer service; and
  • the contents of anything you post in public or semi-public areas of the Website.

3. How We Collect Information About You

We collect information:

  • directly from you when you provide it to us through forms, by phone or by email;
  • through User Contributions you post to public or semi-public areas of the Website;
  • automatically as you navigate through the Website, using cookies, web beacons and other tracking technologies; and
  • from third parties, such as our service providers, and from publicly available sources.

3.1 Information You Provide to Us

The information we collect on or through the Website may include:

  • information you provide by filling in forms on the Website, including when you register for an account, subscribe to our emails or text messages, post material, or request further services;
  • records and copies of your correspondence (including email addresses) if you contact us;
  • your responses to surveys that we might ask you to complete for research purposes;
  • details of transactions you carry out through the Website and of the fulfilment of your orders, including the financial information you provide before placing an order; and
  • your search queries on the Website.

You may also provide information to be published or displayed on public areas of the Website, such as product reviews and photos ("User Contributions"). You post User Contributions at your own risk. Although access to certain pages may be limited, no security measures are perfect, and we cannot control the actions of other users of the Website with whom you choose to share your User Contributions.

3.2 Information We Collect Through Cookies and Other Automatic Data Collection Technologies

As you navigate through and interact with the Website, we may use automatic data collection technologies to collect details of your visits, including traffic data, location data, logs and other communication data, and information about your computer and internet connection, including your IP address, operating system and browser type.

The information we collect automatically is mostly statistical data, but we may associate it with personal information we collect in other ways or receive from third parties. It helps us improve the Website and deliver a better and more personalized service, including by enabling us to estimate our audience size and usage patterns; store information about your preferences so we can customize the Website for you; speed up your searches; and recognize you when you return to the Website.

3.3 Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications on the Website, including advertisements, are served by third parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies, alone or together with web beacons or other tracking technologies, to collect information about you when you use the Website. The information they collect may be associated with your personal information, or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioural) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. You can opt out of several third-party ad networks' use of cookies for interest-based advertising by visiting the opt-out tools of the Digital Advertising Alliance of Canada and the Network Advertising Initiative. Opting out of a network does not mean you will no longer receive online advertising. It means that network will no longer deliver ads tailored to your web preferences and usage patterns.

4. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • to present the Website and its contents to you;
  • to provide you with information, products or services that you request from us;
  • to fulfil the purposes for which you provided the information, or that were described when it was collected, or any other purpose for which you provide consent;
  • to provide you with notices about your account and subscriptions, including expiration and renewal notices;
  • to carry out our obligations and enforce our rights arising from any contracts between you and us, including for billing and collection, and to comply with legal requirements;
  • to notify you about changes to the Website or any products or services we offer or provide through it;
  • to improve the Website, products and services, marketing, and customer relationships and experiences;
  • to contact you about our own goods and services that may be of interest to you; and
  • in any other way we may describe when you provide the information.

Email marketing. With your permission, we may send you promotional emails about our store, new products and other updates.

Text marketing. With your permission, we may send you text messages about our store, new products and other updates, including checkout reminders if you leave items in your cart. Checkout reminders are triggered automatically by our systems. Message frequency varies, and message and data rates may apply. You can opt out at any time by replying STOP.

You can unsubscribe from promotional emails at any time using the unsubscribe link in each email, or by contacting us at support@rooandyou.ca.

5. Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.

We may disclose personal information that we collect or you provide as described in this Privacy Policy:

  • to our subsidiaries and affiliates;
  • in accordance with applicable law, to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, where the personal information held by us is among the assets transferred;
  • to contractors, service providers and other third parties we use to support our business (such as those described in Section 6), who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and process it to the same standards set out in this policy;
  • to fulfil the purpose for which you provide it. For example, if you use a feature to email a friend about a product, we will send the contents of that email and your email address to the recipient;
  • for any other purpose disclosed by us when you provide the information; and
  • with your consent.

We may also disclose your personal information:

  • to comply with any court order, law or legal process, including to respond to any government or regulatory request, in accordance with applicable law;
  • to enforce or apply our Terms of Service and other agreements, including for billing and collection purposes;
  • if we believe disclosure is necessary or appropriate to protect the rights, property or safety of Roo & You, our customers or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

6. Transferring Your Personal Information

We may transfer personal information that we collect or that you provide as described in this policy to contractors, service providers, and other third parties we use to support our business (such as analytics and search engine providers that assist us with Website improvement and optimization) and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this policy.

We may process, store, and transfer your personal information in and to a foreign country, with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country. Whenever we engage a service provider, we require that its privacy and security standards adhere to this policy and applicable Canadian privacy legislation.

By submitting your personal information or engaging with the Website, you consent to this transfer, storage, or processing.

7. Choices About How We Use and Disclose Your Information

We strive to give you choices about the personal information you provide to us. We have created mechanisms to give you the following control over your information:

  • Tracking technologies and advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, some parts of the Website may then be inaccessible or not function properly.
  • Promotional offers from us. If you do not want us to use your contact information to promote our own products or services, you can opt out by using the unsubscribe link in any promotional email, replying STOP to any text message, or emailing support@rooandyou.ca. This opt-out does not apply to information provided to us as a result of a product purchase, warranty registration, product service experience or other transactions.

8. Data Security

The security of your personal information is very important to us. We use physical, electronic and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. We store the personal information you provide to us on secure servers behind firewalls. Any payment transactions are encrypted.

The safety and security of your information also depends on you. Where you have a password for access to certain parts of the Website, you are responsible for keeping it confidential. Do not share your password with anyone. Please be careful about giving out information in public areas of the Website, such as reviews, which any Website visitor can view.

Unfortunately, the transmission of information over the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of personal information transmitted to the Website, and any transmission is at your own risk. We are not responsible for circumvention of any privacy settings or security measures on the Website. We are not liable for unauthorized access to your personal information that is beyond our reasonable control.

9. Data Retention

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting or reporting requirements. We have a retention schedule in place so that we do not keep personal information indefinitely. Under some circumstances we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

10. Children Under the Age of 13

The Website is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Website. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Website or through any of its features. If we learn we have collected or received personal information from a child under 13, we will delete it. If you believe we might have any information from or about a child under 13, please contact us at support@rooandyou.ca.

11. Accessing and Correcting Your Personal Information

It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes. By law you have the right to request access to and to correct the personal information that we hold about you.

You can review and change your personal information by logging in to the Website and visiting your account profile page. If you want to review, verify, correct or withdraw consent to the use of your personal information, you may also contact our Privacy Officer at helen@rooandyou.ca.

We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the personal information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, erased or made your personal information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions. Exceptions may include information that is protected by solicitor-client privilege, is part of a formal dispute resolution process, would reveal personal information about another individual, contains confidential commercial information, or is prohibitively expensive to provide.

If you delete your User Contributions from the Website, copies may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. Proper access and use of information provided on the Website, including User Contributions, is governed by our Terms of Service.

12. Privacy in Respect of Contests

12.1 Purpose and Collection

When you enter a contest, sweepstakes or giveaway run by us (a "Contest"), you provide personal information that allows us to administer the Contest and related activities described to entrants. We collect this information directly from you through the Website or, where a Contest runs on a social media platform such as Facebook, Instagram, TikTok or X (formerly Twitter), from your posts or replies referencing the Contest. Please do not provide personal information about other individuals. If you are selected as a winner, we may contact you for additional personal information needed to administer the Contest and award the prize.

12.2 Use and Disclosure

We use and disclose the personal information collected in connection with a Contest to administer the Contest; to contact and publicly announce winners; to coordinate the provision of prizes; and to audit active or concluded Contests. We may also use and disclose it for promotional purposes relating to the Contest you entered, and for future contests, where you have consented. We may also disclose it where required or permitted by law, including to law enforcement.

12.3 Keeping Information Secure

We store personal information collected through Contests in accordance with our obligations under applicable privacy law and this Privacy Policy. We endeavour to protect its confidentiality and security by maintaining physical, technical and administrative safeguards.

12.4 Third Parties

We may engage service providers to help administer Contests. These service providers are contractually required to maintain security safeguards, and they collect, process and store personal information on our behalf. They may host personal information on servers in other countries, so your personal information may become subject to the laws of other jurisdictions, including the United States.

13. Withdrawing Your Consent

Where you have provided consent to the collection, use and transfer of your personal information, you may have the legal right to withdraw your consent under certain circumstances. To withdraw your consent, if applicable, contact us at support@rooandyou.ca. Please note that if you withdraw your consent, we may not be able to provide you with a particular product or service. We will explain the impact to you at the time to help you with your decision.

14. Changes to Our Privacy Policy

It is our policy to post any changes we make to this Privacy Policy on this page. If we make material changes to how we treat our users' personal information, we will notify you by email to the primary email address specified in your account and/or through a notice on the Website home page. The date this Privacy Policy was last revised is shown at the top of the page. You are responsible for ensuring we have an up-to-date, active and deliverable email address for you, and for periodically visiting the Website and this Privacy Policy to check for any changes.
